Those who use marijuana legally in accordance with their state's laws cannot be sold or possess firearms, according to a Bureau of Alcohol, Tobacco and Firearms (ATF) memo issued on September 21.
The memo to gun dealers in the United States, obtained by the National Organization for the Reform of Marijuana Laws (NORML), stated that it was illegal under federal law to sell firearms to anyone reasonably suspected of using a controlled substance.

Stolen Property, Fictitious Checks Leads To 4 Eureka Arrests

On 9/28/11, at about 7:40 AM, investigators with the Eureka Police Department’s Problem Oriented Policing (POP) and Criminal Investigation Services (CIS) Units served a search warrant at a residence on the 2900 block of Union Street, Eureka.  The warrant was in response to numerous citizen complaints about suspected criminal activity occurring at the property (drugs, stolen property etc.).  Additionally, several forged/fictitious check investigations had led back to the residence and/or its occupants. 

Investigators encountered and detained 4 residents upon entering the home:

·     Ernest (“Ernie”) Alan Rocha (50 of Eureka)

·     Jamie Dean Ladd (20 of Eureka)

·     John Edwin Cochran (27 of Eureka)

·     Genie Kathleen Porter (29 of Eureka)

During a subsequent search of the property, detectives located drug use paraphernalia, evidence of fictitious check manufacturing (forged checks, equipment to make checks, personal/financial account information for multiple individuals), and stolen property.  The stolen items recovered included two license plates, mail belonging to multiple individuals, and a vehicle tire.  The tire was found hidden in the attic and it had been reported stolen with 3 others from a neighboring residence the previous evening. 

Rocha was arrested and transported to the Humboldt County Jail where he was booked for maintaining a place for purposes of drug use/sales, receiving/possessing stolen property, making/possessing fictitious checks, and unauthorized possession of hypodermic syringes. 

Ladd was arrested and transported to the Humboldt County Jail where he was booked for receiving/possessing stolen property, making/possessing fictitious checks, unauthorized possession of hypodermic syringes, and probation violation. 

Cochran was arrested and transported to the Humboldt County Jail where he was booked for receiving/possessing stolen property, making/possessing fictitious checks, and possession of drug paraphernalia.

Porter was arrested and transported to the Humboldt County Jail where she was booked for receiving/possessing stolen property, making/possessing fictitious checks, and possession of drug paraphernalia (meth pipe).

The investigation is continuing and additional arrests/charges may result as suspected stolen property and personal/financial account information belonging to multiple victims was located in the suspects’ home.

Access Humboldt Challenges FCC's Open Internet Rules

Wednesday, September 28 – This week Access Humboldt petitioned the Ninth Circuit Court of Appeals for review of a Federal Communications Commission (FCC) decision. Access Humboldt says that the recently published decision, Preserving the Open Internet (Report and Order), 25 FCCRcd 17905 (2010), wrongly discriminates between Internet access via mobile devices like smart phones and Internet access via fixed platforms like cable and telephone, and that the rules are legally unsound.

“The FCC’s decision is just too weak,” says Sean McLaughlin, executive director of Access Humboldt. “The rules do not provide the strong foundation needed for truly open, innovative networks. So we have a duty to challenge them in Federal Court.”

In filing their petition, Access Humboldt is represented by Media Access Project and joins a national effort to protect nondiscriminatory, “network neutral” consumer access to all of the Internet’s legal content. Free Press, a national, nonpartisan, nonprofit organization working to reform the media also filed a petition this week on similar grounds.

“The rules passed last December are riddled with loopholes,” says Matt Wood, policy director of Free Press, a national media reform organization. “They don't do enough to stop the phone and cable companies from dividing the Internet into fast and slow lanes, and they fail to protect wireless users from discrimination that is already occurring in the marketplace and that will only get worse.”

As the rule stands now, cable and phone Internet Service Poviders (ISPs) cannot let some websites load faster than others or block access to websites that do not pay the ISP a premium, the so-called “Pay-to-Play” system. For example, cable company Comcast cannot throttle their Internet customers’ access to online movies from Netflix. The FCC does not require wireless ISPs to adhere to the same rules. This has triggered lawsuits from cable and phone company giants fearing their new competitors will benefit from not having to follow the same rules.

“Any commercial arrangements that lead to a small, closed ‘faux-Internet’ rather than the complete, all-encompassing internet goes against the basic human right of freedom of information and expression,” says McLaughlin. “The Internet belongs to everyone and we need rules to protect it that support open access for everybody, regardless of income, technology or location.”

After petitions are filed by industry and public interest groups, the Federal Appeals Court will determine by lottery in which Circuit the case will be heard.

Kevin Scott Walker Gets 18 Years For Rape And Assault Committed Near Arcata Sports Complex

I have received word that 37 year old Kevin Scott Walker who was accused of raping a 25 year old woman last Summer near the sports complex in Arcata has lost his Humboldt County jury trial. He has reportedly been sentenced to18 years in prison. 

The rape he was accused of took place on July 5^th. 2010 in some woods just yards away from where a baseball game was taking place. 

According to the Times-Standard, In 2008, Walker pleaded guilty to felony assault in what was believed to be a hate crime incident in Trinidad. He was arrested in May 2008, after witnesses reported him and two other men fighting in a Trinidad beach parking lot. Witnesses said Walker and another man were holding a third man on the ground, hitting him in the head with a metal pipe and stepping on his face while shouting racial slurs.
Walker and the other assailant, Collin Roczey, were arrested on suspicion of assault with a deadly weapon, sexual assault and kidnapping, and later pleaded guilty to the assault charge in a plea agreement carrying a prison sentence between two and four years.

Governor Signs Evans’ Bill To Protect State’s Crab Fishery

Sacramento – Governor Jerry Brown today signed major fisheries legislation by Senator Noreen Evans (D- Santa Rosa) that will help ensure the economic and environmental sustainability of California’s Dungeness crab fishery.

“It has been a long road getting here, but with the cooperation and close involvement of our fishermen they now have the rules they wanted to protect the future of both our fishermen and the Dungeness crab fishery,” said Senator Evans.

The bill, SB 369, sets crab trap limits, which will prevent large boats from out of state from swooping down early in the season and crowding out state’s fishermen. The bill puts California on an even competitive playing field with Oregon and Washington, which already have crab trap limits.

The new crab trap restrictions, which are supported by the west coast’s largest fishing and marketing association, the Pacific Coast Federation of Fishermen’s Associations as well as the Environmental Defense Fund, will over time reduce derelict gear in the water, preventing entanglements of marine mammals, and will make crab fishing less dangerous.

“Today’s signing was the culmination of a long process involving over several years hundreds of crab fishermen and processors, the Department of Fish and Game, and fishing and environmental groups, and a bipartisan legislature, “ said Senator Evans. “I think this bill shows that disparate groups can work together to create mutually beneficial policy.”

SB 369 follows the recommendations of the former Dungeness Crab Task Force which met in 2010 and proposed legislation to restrict the numbers of crab traps in the water. Under SB 369, fishermen are assigned crab trap limits based on their documented history of Dungeness crab landings. Crab fishermen purchase crab trap permits and pay tag fees which pay for the trap tags and the administration and enforcement of the program. Only fishermen who are eligible to own California crab vessel permits can purchase the crab trap permits.

The bill also:

· Extends the current crab trap vessel permit program, which was due to expire in January 2012 to January 2020. Without this extension, the Dungeness crab industry would be largely unregulated and wide open to anyone wanting to take crab for commercial purposes.

· Reestablishes the Dungeness Crab Task Force to review current programs and issues in the industry and make recommendations to the Legislature and the Fish and Game Commission.

State Senator Noreen Evans represents the Second Senatorial District, including all or portions of the Counties of Humboldt, Lake, Mendocino, Napa, Solano, and Sonoma. Senator Evans Chairs the Legislative Women’s Caucus and the Committee on Judiciary.

No Boats In Trinidad Bay, Not One

I looked over the edge of the cliff this afternoon and wondered, where did all of the boats go?  They normally thin out this time of year but there are usually at least 2 or 3 boats out there all year.  Nothing. Not even a kayak.

It wasn't the half inch of rain that fell on Trinidad overnight that drove them away, but the lack of access because the pier is closed.  This doesn't account for the lack of kayaks but it does explain why there are no real boats out there. Construction of a new pier is underway and a large crane can be seen at the foot of the old pier which is still standing.  Creosote from the old pilings is bad for the bay and some of the pilings were about gone at water level, just rotted out.

Unlike the old pier which was built of wood the new one will utilize two materials, concrete and steel.
Now I'm no architect or engineer but aren't those the same materials that failed badly about a decade ago in lower Manhattan when a 42 story skyscraper built in the 1980's fell out of the sky at free fall speeds due to some small fires?  Lets just hope people don't smoke near the new pier.

The SeaScape restaurant is still open and is a good place to watch one of the few construction jobs actually going on anywhere in the U.S.

According to a PDF from Trinidad Rancheria:

"The existing pier and improvements are to be removed and replaced with approximately 13,500 square feet of pre-cast concrete decking, 115 cast-in-steel-shell concrete piles, 53 plastic/fiberglass fender piles, four hoists, standard lights, guardrail, and dock utility pipes including water, power, and phone. Removal of the existing pier and construction of the new pier will occur simultaneously. Reconstruction activities will begin at the south end and will progress in sections moving towards the land. All structures and utilities will be removed from the section of pier deck being reconstructed."

NEW YORK (Reuters) - Several hundred marchers wound their way through the streets of lower Manhattan on Saturday in the latest of a string of protests over the past week against what demonstrators saw as corporate greed on Wall Street.

Police sa at least 80 protesters were arrested during the march, which was meant to criticize a financial system participants said unfairly benefits corporations and the rich. They said the protests were inspired by demonstrations in Egypt and Spain.

On August 9th, 2007, Eureka police officers Justin Winkle, Gary Whitmer, Adam Laird, and five others were involved in beating an unarmed Martin Cotton II to death. Eureka police pummeled Martin Cotton's body and head in broad daylight, using pepper spray repeatedly. Martin Cotton was then sent to jail without being offered medical treatment. He died in jail within about an hour. A federal civil rights trial in Oakland was filed to seek justice for Martin on behalf of his young daughter. The case, Siehna Cotton et al v. City of Eureka, included the testimony of police readily admitting they beat Martin Cotton all over his body and did not seek medical assistance for him afterward. The police however denied that they hit Martin Cotton in the head, most likely because blows to the head were determined to be the cause of death. At about 1pm on September 23rd, the verdict was announced for the two-week trial. A seven-person jury found unanimously in favor of the plaintiffs, big time. Siehna Cotton was awarded $1,250,000 for the pain Martin Cotton suffered at the hands of Eureka police and $2,750,000 for wrongful death damages. Additionally, Marty Cotton Sr. was awarded $500,000, which required plaintiffs to meet the highest burden of proof in a civil trial, that is that the murder of Martin Cotton "shocked the conscience." A rare award of punitive damages against the three officers required a finding of "malice, oppression, or reckless disregard" to the decedent's or plaintiffs' rights, for which the jury assessed $30,000 from officer Winkle, $30,000 from officer Laird, and $15,000 from officer Whitmer, who arrived at the scene late but joined in on the beating. Crucial to the verdict was the testimony of two witnesses who bravely reported that they had indeed seen at least officer Winkle striking Martin Cotton's skull. Painful video of Martin Cotton dying in jail was presented during the trial which obviously effected jurors, four of whom wore black in solidarity with the family today as the verdict was read. Eureka Loses Martin Cotton II Civil Rights Case In Oakland

I am still waiting for the official press release but I can confirm that in the case of "Siehna Cotton et al v. City of Eureka", the city of Eureka has lost the case.

The case was was held in Oakland Ca. before U.S. District Court Judge Saundra Brown Armstrong and a seven person jury. The jury has awarded Siehna Cotton, (Martin Cotton's daughter)  $4-million dollars. They also awarded Cotton's father half a million dollars in the case. 

The case focused on 3 EPD officers that were seen beating Martin Cotton II on August 9th, 2007.  The officers are Justin Winkle, Gary Whitmer and Adam Laird.  Punitive damages were awarded according to my source.

CIVIL RIGHTS TRIAL ABOUT FATAL POLICE BEATING OF MARTIN COTTON CONCLUDING THIS WEEK

Oakland, CA: The current civil rights trial in Oakland about the Eureka police murder of Martin Frederick Cotton II resumes Wednesday, 9/21. Four years ago, Martin was 26 years old, unarmed and living on the streets when he was killed by the Eureka Police when they pummeled his body in broad daylight, in front of a homeless shelter (Eureka Rescue Mission), then brought him to the jail to die. Cotton family supporters who are deeply opposed to police violence, rallied in front of the Oakland courthouse on the first day of trial (Sept 12) and have been present in the courtroom while attorneys Vicki Sarmiento and Dale Galipo represent Martin's six year old daughter, Siehna, and her grandfather, Martin Cotton Sr. The case, Siehna Cotton et al v. City of Eureka is being heard before U.S. District Court Judge Saundra Brown Armstrong and a seven person jury. Martin's story has spread beyond the “Redwood Curtain”.

The fatal police beating occurred in front of many witnesses, mostly homeless people already in vulnerable situations. On August 9, 2007, two Eureka Police Department (EPD) officers responded to a call about a disturbance involving Martin at the Mission. When they arrived, Martin was no longer inside and was alone and defenseless when both officers immediately pepper-sprayed him, kneed him to the ground and brutally beat him. Martin was passive, made no moves against the police and remained prone on the concrete. More officers arrived and joined the beating. Officers admitted at trial that they sat on Martin and forced his head onto the concrete throughout the beating, hit him with a metal baton and with their knees at vulnerable organs, kicked him, and deployed pepper spray three times.. The officers deny that any of them hammerfisted Martin in the head against the cement many times.  Two unrelated civilian witnesses testified that they clearly saw head blows coming from the officers. One witness said he heard “fist-to-skull”, “bone-on-bone” from very hard blows to Martin's head. 

Marty Cotton, Sr. says, “We want to expose the truth, ideally, so those cops can never wear a badge and weaponry and never do this to anyone else again.”

The names of the eight EPD officers involved in the deadly torture of Martin Cotton were never revealed by the mainstream media or local government, and only made public by Redwood Curtain CopWatch.  The lawsuit is now only focused on three of the officers: EPD's Justin Winkle, Gary Whitmer, and Adam Laird (who has since been promoted to Sergeant).The officers have testified and contradicted their attorney's arguments that Martin appeared to be a drugged up 'superman' requiring extreme force to be detained and questioned. The officers testified that they did not believe Martin was on drugs, that Martin reacted normally to the pepper spray, and that it was clear he had no weapons and was not trying to get away. One consistent observer of the trial said “The cops are claiming that they pepper-sprayed Martin, got on top of him and beat him repeatedly, even with a metal baton, just to get Martin's hands out from under him. It is absurd, or more accurately, obscene...and it killed him.” Also, the officers testified that they did not think Martin was hurt and did nothing to get him checked out or treated -after “exhausting” themselves beating and spraying him. A video of Martin dying in the jail cell was shown at trial.

Support for the Cottons has been consistent at trial from the Oscar Grant Committee, Redwood Curtain CopWatch, and the Transport Workers Solidarity Committee. 

Humboldt County officials and media fabricated facts and actively covered up the police murder of Martin Cotton for four years. There was no coroner's inquest or criminal prosecution for Martin's murder. The coroner and police fed the public outrageous theories, that Martin died of an LSD overdose, banged his own head to death in the jail, or died from 'excited delirium,' while witnesses spoke of a horrendous police beating. Martin's brutal murder was part of a killing spree by police in the Humboldt region from fall 2005 to fall 2007. Verbena of CopWatch says “There can never be 'justice' for Martin Cotton, but we hope this trial brings some peace to the Cotton family and has a deterrent effect on the cops, who regularly and viciously attack homeless people, and are increasingly more blatant and brutal with all of their targets- the people.” ###

I met him some years ago when he was with the voter confidence committee. Dave Berman and I have been friends since then. I can't remember who started their blog first but we both had that in common. I went from all over the place in the blog for the first couple of years but was forced by management to shut down that first blog. I started this blog later that day and have focused more on local stuff as I have progressed. 

Dave started with a book called "We Do Not Consent", I think there were two volumes and he had a blog by that name. It was what he called advocacy journalism and dealt with voting machine transparency and peaceful revolution stuff. He then started Manifest Positivity. The name says it all. 

Well, Dave grew that little blog into a dot com and learned something called NLP or Neuro-Linguistic Programming. You can learn all about it here. 

Now on facebook Dave has been helping people by "helping the YOUniverse conspire on your behalf." So what could go wrong if he says he can help me quit smoking? I took him up on it. It took me two 90 minute sessions with him and the want to be free of cigarettes.

 It was over two months ago and I feel so much better. I have a lot more energy and money. I was spending about 240 dollars a month on smokes. I went to a Crabs game before the season ended and didn't have to go out for a smoke which was cool.  Long movies, airplanes, buses, the Arcata plaza, it's all different now. I can smell the ocean again. I don't see the people at the gas stations where I used to get my fix.  No standing outside at work unless I just want to see the sun on one of its rare appearances.

  I have tried many times to quit before only to fail two or three days later. This time I really wanted to quit and it worked. I know someone that this didn't work on so it might not work for you if you aren't really committed. Abalone die-off along the Sonoma coast due to red tide

Closure of Abalone Fishery Under Consideration

 The California Fish and Game Commission will consider emergency action on Thursday, Sept. 15 to possibly close the abalone fishery along the northern California coast. This action is being considered in the wake of confirmed reports of dead red abalone and other invertebrates on beaches and inside coves along the coast in Sonoma County.

The Department of Fish and Game (DFG) is currently attempting to assess the impact of the situation and will provide the Commission with information at this Thursday's meeting. Based on the DFG’s report, the Commission may take emergency action to close the abalone season along all or parts of the Sonoma coast.

There was an abalone die-off along the Sonoma coast beginning Aug. 27 as a result of a red tide-induced poisoning and/or lack of oxygen. According to DFG biologists, these abalone deaths coincided with a local red tide bloom and calm ocean conditions. Although the exact reasons for the abalone deaths are not known, invertebrate die-offs have occurred in the past along the northern California coast when similar weather and bloom conditions existed.

The number of dead and dying abalone is not known but DFG divers are assessing the damage this week via underwater transect surveys. Reports of dead abalone and a variety of invertebrates have come from Bodega Bay, Russian Gulch, Fort Ross, Timber Cove and Salt Point State Park. Other DFG biologists and game wardens have collected abalone, mussels and water samples since the beginning and are continuing to document reports from the public.

I believe they did it with a field goal. I don't have any other stats other than 6 thousand green and white t shirts were given out to the crowd to cheer the jacks on.  Exciting football and it started after Obama's speech so I didn't miss anything.  I didn't have the fancy CBS Sports tv channel that the game was broadcast on nationwide but the radio got me through.

Respect For First Responders And A Local Response

One block away from a 9/11 memorial in Old Town Eureka scheduled for 7 pm tonight was another reminder of why we have these people around.

Roofers working in a building housing St. Vincent De Paul, found themselves running for their lives as things started to collapse.  Everyone got out safely and the fire department has been putting in new wood and shoring things up until contractors can get in and do some serious work.

A square block of Old Town Eureka was blocked off today while the firemen did their work.  There was fear that the entire building would fall into the surrounding ones.
 Here is to our first responders that show up before anyone knows if it is safe or not and goes in anyway.  Thanks for what you do. 

9/11, Ten Years Later And What Have We Learned?

The 10 Year Anniversary of 9/11 is this Sunday and there will be much said about the events of that day but little of substance other than that of the lives that were touched and separated on that day. 

 Most people won't ask the real questions and will just accept the official conspiracy theory put forth by the 9/11 Commission. This is the same commission that didn't even address the collapse of building 7, a 42 story building that was not hit by a plane but collapsed that day in the same manner as the two main towers.

Here are some interesting facts, yes facts and also questions that need to be answered to avoid having the same thing happen again.

There are some people who can win any argument or debate, no matter whether they are right or wrong. Lawyers, for example, make really nice livings convincing juries that the most obviously guilty criminals are innocent. So goes the modus operandi of the 9/11 truth de-bunkers out there: wrong or not, they are always right. Or at least, like the lawyers, they appear to be right.

First off, let me correct myself and apologize for the inaccurate title of this article. I used the phrase "9/11 conspiracy theory" in order to speak in terms most people understand. In reality, I am referring to the truth about 9/11, rather than any so-called "conspiracy theory. " In other words, I am referring to the thousands of undisputed, officially endorsed but disturbing pieces of information related to the attacks of 9/11, that, when actually examined, chronicle a far different story than the one told to us by our government and their reality manipulators known as the establishment media.
As I have clarified in previous articles, these disturbing facts and details are not in dispute; they are, however, not known by the majority of people. Thank you establishment media, for a job well done.

That said, let me clearly explain why the opinions and claims of people who argue in support of the official story, whom I like to call "myth huggers," and who try to shoot down (no pun intended), explain away or outright deny the many disturbing questions that remain about 9/11, can NOT be regarded as valid in any way, shape of form.
Before I detail the invalid arguments and deceptive techniques of the myth huggers, I have to point out three important fundamental problems that these people have before they even begin to make their claims:

1. They start with the assumption that the official story is absolutely true. Interestingly enough, I started from this place, too. So, having been a myth hugger at one time, I know what I am talking about.. Hindsight is 20/20, so I am able to see the errors I made in the past. But, in order to formulate an opinion about 9/11, one has to look at things objectively. You have to be impartial - and that is the crux of the problem. It is very emotionally difficult to entertain the possibility that the people who you thought were on your team may be the enemy. Nonetheless, starting off with an absolute belief in one explanation makes it impossible to fairly or even accurately evaluate evidence. If myth huggers were subject to jury selection, they would be dismissed for being biased at the start and therefore incapable of making fair judgments about evidence and testimony. And that, in a nutshell, describes the audience to whom 9/11 truthers have to to make their case.
2. Myth huggers naively believe that people in an American government do not lie and would not do horrible things to "their own people." In fact, any one who actually believes that Dick Cheney, Donald Rumsfeld, Paul Wolfowitz, Richard Perle, or any of their neocon cohorts would lose a minute of sleep or shed a single tear over the deaths of a bunch of liberal New Yorkers, he or she is clearly living in another reality!!! The victims of the 9/11 attacks cleared the path for trillions of dollars in profit for these men and their partners in the military industrial complex. Myth huggers close their eyes to the reality that power brokers are ruthless men who view us all as pawns. They would just as soon blow us up in a building as they would sacrifice our lives by sending us to fight in a war to accomplish their goals.
3. Myth huggers and the people who listen to them really believe that this nation has a real television journalism industry. There are real journalists are out here, but we are not allowed to appear on TV, not even in the so-called liberal media. Don't believe me...just ask Mike Malloy, who was pretty much booted from that old 'liberal' radio network, Air America. for speaking the truth about topics that are not permitted to be aired or even acknowledged as reality.

It's called this weeks McKinleyville Press and it's only .50 cents.  You'll also get local news and other stuff.  It's a good buy for four bits.  If you are too cheap but still turn to the arts,  the Gazebo at Saunders park will have the bocce ball court and local musicians are encouraged to join in.  If in doubt, just look for people having a good time between Westhaven Center For The Arts and what I like to call downtown Trinidad.   There will be art, music, food and storytelling everywhere from 6 to 9 pm Friday, September 2nd. 2011.

Oh yeah, if you can't make it, try the first Friday of any month.
