More Arrests At Occupy Eureka

Below is a release I got from P.A.R.C. tonight. Caution, the font gets pretty big.

In the latest show of complete lawlessness and blatant disregard for the Constitutional Rights of the Citizens of Humboldt County, the Eureka Police Department has once again raided the Occupy Eureka site and stolen both the Information Booth and the Scott Olsen Social Center. In addition to this robbery, they have also kidnapped 2 of our Comrades - Kimberly Starr and Stanton Woods are now being held in the Humboldt County Jail despite the fact that they were doing nothing other than exercising their First Amendment Right to speak and hand out literature in a public place. The EPD is trying to claim that Kim Starr was in violation of a court order when she handed out fliers. At the court proceedings to which the EPD were referring, Judge Cissna EXPLICITLY, on the record, said that she was free to speak and hand out papers on the sidewalk. They claim that she further violated orders by erecting the Scott Olsen Center (which was not blocking the sidewalk or in any other way impeding foot traffic and was only there to protect the information table from the weather and as a gathering place for Occupiers and conversations) even though she never even touched any part of it.

DEMAND THE RELEASE OF KIM STARR AND STANTON WOODS. Don't allow the Paul Gallegos and the Humboldt County Jail to keep these activists locked up. Remind them that Penal Code 825 requires them to bring Kim and Stan in front of a judge (for arraignment) "without unnecessary delay, and, in any event, within 48 hours after his or her arrest."

DEMAND THE RETURN OF OUR STOLEN LITERATURE, BANNERS, AND SUPPLIES!!
Call and email the Eureka Police Department, Property Officer Erin McBride mhtml:{D5A20625-9BC6-40A9-88A7-D17CA13E0F33}mid://00000039/!x-usc:mailto:emcbride@ci.eureka.ca.gov, and Temp. 1. The police are doing what is legal. It is the protesters that want to be confrontational. Free Speech is not being limited.

  2. "It is the protesters that want to be confrontational."

That's 100% completely refuted by the undeniable fact that the police have initiated confrontation on every occasion. The protesters want to be left alone to protest.

  3. Sure, and the concrete that flew at police was what exactly?

  4. The concrete was asphalt exactly. Violence begets violence.

  5. The asphalt was a result of our crumbling infrastructure. That's what the 99 percent movement is all about. We need to invest in this country and it's people. Cops are in just as much danger driving over or under bridges made of the same crumbling materials. The 99 percent also is at risk from this. They may not drive but they do ride on the same roads.

  6. If they judge state you are not to erect a structure and you tell the officer that you were the one to erect the structure...guess what VIOLATION OF COURT ORDER!!!
Building structures is prohibited. Protesting is not prohibited. Committing a crime while exercising your First Amendment rights does not make you exempt from prosecution for the law(s) that your violated.
I'm in complete agreement with the Occupy Movement...however I'm not in agreement what-so-ever with individuals who have their own personal beef with law enforcement and want to rile them up.
