Left Waiting: A California Workers Comp Story

As someone going through this maze of insurance forms, long drives and denial of service. I felt a need to share this with others that are facing this in the State of California. You could lose everything while waiting for help. This shouldn't happen to people that get hurt while on the job. I broke my wrist, back and neck at work May 6th 2017. I have had a QME and the insurance company carrier has denied the doctors recommendations. And so I wait, and wait and wait.

Injured workers in California often wait months or even years to receive the medical evaluations required to get needed treatment, and in some cases to determine how disabled they are as a result of the injury.

The reason? The state lacks enough physicians signed up with the state’s program to serve as experts.

That’s among the findings of a first-ever state audit of California’s Division of Workers’ Compensation, which noted that the state has not increased the pay schedule for expert doctors, known as Qualified Medical Evaluators, in 13 years.

“It’s affecting real workers, and if something is not being done correctly, they need to fix it,” said Democratic Assemblywoman Blanca Rubio of Baldwin Park. She requested the audit as a member of the Joint Committee on Legislative Audit, which will hold a hearing on the findings Tuesday. “But if it doesn’t get fixed, then we can step in and fix it. The department needs to take it seriously.”

  1. Workers comp rates are bullshit...in construction, they rate laborers as if they are specialists at anything other than grunt labor...check into the classifications...

    Same tactic by State regarding IC's...

    Rates are decided by an out of state board which is independent and separate from scif...state comp insurance fund...

    Ripping off employers to cover for the high costs implemented by scif...and the state legislature...

    State comp was sued years ago for over charging and hiding the funds as a slush account...it was a class action suit if memory serves...

    Then, of course, the difficulty with employees who intentionally injure themselves just to get paid without having to work...typically the kind of faked injuries that are not obviously painful, just very fakeable...and the medical system does nothing so often at forcing the accuser to prove their claims to fame and pain...

    One time off the job, a bitch neighbor who was injured at Ray's food mart (cut hand) attacked HOJ while using that injured hand to engage in assault and battery against HOJ who was leaning up against a gate post enforcing a legally binding real estate contract...during her a/b, she re opened her occupational injury, but attempted to spin the injury onto HOJ...of course her attorney attempted to smear, but could never convict at trial because Henchy had so much a/v evidence...she was a crackpot who had previously hit and run HOJ with her car, lied to officer taking a report, allowed her car to be stolen intentionally to get damaged more to taint the vehicle damage caused by her hit and run...so Henchy sent in the tape to his insurance once her insurance company denied HOJ's claim after only a few days...her insurance wrote a one paragraph letter saying they wanted to connect with HOJ, then 2 days later, without even being in contact with HOJ denied the claim...but she got caught revving her vehicle and running down HOJ from behind... you think she would have stopped but no she increased her attacks using her children and her children's friends going forward... she was just really an evil person who had the extra incentive to be evil because her husband was cheating on her... not all Native Americans are good people so they moved back to Oregon from whence they came...

    So that's what you can expect when you're victimized from insurance companies, the cops who sided with her, the courts and attorneys who just accuse men of everything bad whenever a woman is involved, and the sad part is is it happens to so many people every day in their own circumstances...

    ... people who are truly victims of injuries don't get their Justice while people who faked it get all the help in the world... hence the fuck America meme... hence the "no such thing as Justice" meme...

    Watch Lincoln Lawyer the other night and noticed a scene where Matthew McConaughey who is the acting attorney uses a restroom urinal but doesn't wash his hands after which... it was a great slight regarding attorneys and how dirty they are...

    Good luck Tom with the wild goose chase... you're experiencing what so many people before you have and will continue to in the future especially in the state of California where everything is backwards it seems!

  2. If people were punished for faking their injuries then it would allow those with real injuries to be treated much sooner... think about all the paperwork involved with people who fake injuries... and how much time it takes away from servicing those people who have a legitimate injury...

    ... it should not ever happen in America, but in California, it has been taken over by leftists in control who already want everybody to be a victim so therefore they turn a blind eye to the con artists the people that fake stuff... nothing better for the economy than a good crisis... and if you punish those who don't have much if anything at all then it makes them have less than what they had never had to begin with... more poor than the poor they were...

    ... a state where a person can burglarize homes with their friends for jewelry and other material items, get caught and then be signed by Hollywood types for a reality show...

    So many examples of the bad being rewarded and the good being punished...

  3. Thanks for your insight HOJ. I’m just glad I got a lawyer. I wasn’t very far into this and I could tell things weren’t going very well. but still I think they’re just hoping I’ll die before they ever have to pay a penny .😢

  4. Glad to hear you got a lawyer Tom. Worker's Comp insur companies stall & stall on purpose to wear you out so you finally accept a low ball offer. Attorneys are limited by law to a percentage of what you get and know how to not underprice your injury.
